OilFox Service Terms and Conditions
These Service Terms and Conditions are subject to and in addition to our General Terms and Conditions of Sale (please see our website for details). These Service Terms apply where you receive the OilFox Service an FoxRadar Device from Northern Energy Oil Ltd.
Service: The OilFox fuel monitoring services which we are providing you
Device: FoxRadar, and oil level monitoring device
Term of Contract: A period of 36 months from receipt of the device (unless otherwise and explicitly stated and agreed)
Ownership of the device:
Except where you buy the Device outright, the Device remains the property of Northern Energy Oil Ltd for the Term of Contract. During the Term of Contract, the fee chargeable includes the Device itself and the OilFox fuel monitoring services. Once the Term of Contract has expired and full payment has been received, ownership of the Device will transfer to you, and we will charge you a fee for the monitoring services supplied from there onwards which will be due upfront on an annual basis.
Payment for the OilFox Service and FoxRadar Device:
Payment for the Term of Contract will be due annually and is to be paid upfront for each forthcoming year during the Term of Contract, unless you buy the Device outright, in which case full payment will be required prior to delivery of the Device.
If you do not pay us for the OilFox Service and FoxRadar Device when payment is due, we may suspend supply of the Service until you have paid us the outstanding amount. We reserve the right to remove and reclaim the Device, and claim all outstanding sums for the full Term of Contract.
The Device uses GSM/2G NB-loT, Cat-M and WIFI to communicate. The Service is only available if our service providers’ networks are successfully received at the point of installation. If no signal can be picked up at point of installation, the Service will be cancelled with immediate effect and any funds received upfront in respect of payment for the Device will be refunded.
We will regularly collect data from your Device to gauge the volume of product in your tank. We may contact you when the Device indicates that the volume of product in your tank is at a level where a delivery of product is advisable.
Damage to the Device:
You must not interfere with the Device or obstruct the operation of the Device. Should the Device be damaged, lost or stolen by you or a third party, you will become liable for the full replacement and/or repair costs. However, should the Device become defective during the Term of Contract, we will repair or replace the Device at no cost to you. Whilst a Device is defective and until a replacement can be supplied, our obligation to provide the Service is suspended. This shall not affect your obligation to pay the price for the Service unless we fail to supply a replacement Device within a reasonable period.
We will provide the Service for the Term of the Contract. At the end of the Term of Contract, ownership of the Device will transfer to you. We shall continue to provide the Service at a monthly cost and you will continue to pay for the Service unless you cancel the Service by providing us with 30 days notice in writing. Payment will be made annually upfront.
If you cancel the Service at any time and for any reason during the Term of Contract by providing us with 30 days notice in writing, you will pay to us any outstanding balance in respect of the cost of the Device for the entire Term of Contract.
If you cancel the Service during the Term of Contract because you are moving home then you must give us 30 days notice in writing. You will be responsible for returning the Device to Northern Energy Oil Ltd.
We reserve the right to amend these Terms and Conditions from time to time.
